Powers of Attorney/Adults With Incapacity
A Power of Attorney is a legal document which permits someone (appointed by you) to make decisions for you when you are not capable of doing so. Your Power of Attorney can be drafted to include powers in relation to your personal welfare, financial affairs or a combination of both.
Appointing A Power Of Attorney
We regularly prepare Powers of Attorney for clients who want to plan for a situation in the future where they may not have the mental or physical capacity to look after themselves. Whatever your reason for appointing an attorney, our Solicitors are happy to advise on the powers required and the situations in where your Attorney may act.
Appointing A Guardian
In some situations, a Power of Attorney is no longer possible due to an existing lack of capacity. In these situations, your family or friends might require to go to court and seek to be appointed as your Guardian or to obtain an Intervention Order or to obtain approval from the Public Guardian for Access to Funds belonging to you.
We can advise on all types of application which may be appropriate under the Adults With Incapacity legislation including those outlined above.
